La façon dont le cas de Nzoy est traité nous montre, une fois de plus, comment le Ministère Public et l’Etat de Vaud assurent au corps policer une impunité totale. Vaud est le canton qui compte le plus de cas de meurtres policiers et, à chaque fois, les victimes sont des personnes d’origine afro-descendante. Au niveau tant national qu’international, les agissements du Ministère Public dans les affaires de décès de Mike Ben Peter, d’Hervé Mandundu et de Lamin Fatty inquiètent. Les autorités suisses sont fréquemment pointées du doigt par les organes internationaux de contrôle en matière de droits humains et de prévention contre la torture, notamment pour leur manque d’efficacité et d’impartialité dans les enquêtes concernant les violences policières. Cette année, la Suisse a été condamnée pour la première fois pour profilage racial par la Cour européenne des droits de l’homme, mais l’Etat préfère s’enfermer dans le déni.

En théorie, s’il est soupçonné que la violence recouvre un caractère raciste, les enquêteurs ont l’obligation d’étendre l’enquête à “cette circonstance aggravante spécifique”. Or, l’Etat de Vaud refuse d’admettre le racisme systémique et systématique de ses institutions - du pouvoir exécutif au pouvoir judiciaire - et refuse de traiter les violences policières comme une conséquence de ce racisme. La police tue, le Ministère Public acquitte et dédommage les agents et l’Etat de Vaud laisse faire en invoquant les notions d’État de droit et de séparation des pouvoirs. Un État dans lequel les agents ne respectent pas les règles impératives qui s’imposent au reste de la population n’est pas un État de droit.

C’est pourquoi nous revendiquons une enquête indépendante et délocalisée hors du canton de Vaud afin d’éviter une proximité problématique entre la police et le Ministère public vaudois.

Après des manifs à Morges et Zurich, des soirées de soutien aux quatre coins de la Suisse, retrouvons-nous le samedi 31 août à Lausanne pour crier notre colère, trois ans après les faits.

Ce système a maintenu jusqu’à aujourd’hui l’impunité totale de la police. Nous nous mobilisons pour que cela cesse, pour qu’il s’effondre et pour que justice soit faite.

Justice 4 Nzoy ! : call to action on 31 August 2024 in Lausanne

On 30 August, 2021, Roger Nzoy Wilhelm, a 37-year-old black man living in Zurich, was shot three times by a police officer on a platform at Morges train station. The police officers who were present at the time left him lying on his stomach for 6 minutes without giving him first aid.

In spring 2023 the prosecutor in charge of the case announced he would not be indicting the other officers for failure to render to aid. Then, in autumn of 2023, he finally informed the Wilhelm family’s lawyer that in the absence of new elements by 10 November 2023 he would close the case – thus depriving the family from the right to a trial and to a serious investigation.

The way Nzoy’s case was dealt with shows us once more how the canton of Vaud and its public prosecutors’s office ensure complete impunity for the police. Vaud is the canton with the highest number of police murders and, every time, the victims are afro-descendants. Both national and international entities have raised concerns about the actions of the Public prosecutor’s office, and they are particularly worrying in death cases such as for Mike Ben Peter, Hervé Mandundu and Lamin Fatty. Swiss authorities are often criticized by international oversight agencies on issues like torture and human rights violations, particularly due to their inefficiency and lack of impartiality when investigating cases of police violence. This year, Switzerland was condemned for racial profiling for the first time by the European Court of Human Rights. But the State chooses to remain in denial.

In theory, if there is a suspicion that violence may have a racist motivation, investigators are required to investigate this “specific aggravating circumstance”. However, the canton of Vaud refuses to acknowledge the systemic and systematic racism of its institutions – from the executive to the judiciary powers – and refuses to treat police violence as a consequence of racism. Police kills, prosecutors clear and compensate officers, and Vaud lets them do so by invoking notions as the Rule of Law and the separation of powers. A state in which police officers evade rules that are imperative for the rest of the population is a state without a rule of law.

For these reasons we call for the systematic conducting of administrative inquiries in cases of police violence involving suspicions of racism in order to ensure the impartiality and celerity of public prosecutor’s investigations.

Following a number of rallies, marches and supports events in Morges, Zurich and all over Switzerland, we are mobilizing again on Saturday 31 August 2024 in Lausanne to shout our anger, three years after Nzoy’s death.

The system has granted Vaud Police complete impunity until now. We are mobilizing for this to end, to bring this system down and for justice to be served.

Am 30. August 2021 wurde Roger Nzoy Wilhelm, ein 37-jähriger schwarzer Zürcher, auf dem Perron in Morges von einem Polizisten mit 3 Kugeln erschossen. Die anwesenden Polizist*innen liessen ihn 6 Minuten verletzt auf dem Bauch liegen, ohne erste Hilfe zu leisten.

Im Frühling 2023 gab der zuständige Staatsanwalt bekannt, dass er die anderen anwesenden Polizist*innen nicht wegen unterlassener Hilfeleistung strafrechtlich verfolgen werde. Ausserdem teilte er im Sommer 2023 der Familie von Nzoy über deren Anwalt mit, dass er den Fall einstellen werde, wenn bis zum 10. November 2023 keine neuen Beweise vorgelegt würden - was Nzoys Familie das Recht auf ein Gerichtsverfahren und eine ernsthafte Untersuchung nähme.

Die Art und Weise, wie der Fall von Nzoy behandelt wird, zeigt einmal mehr, wie die Staatsanwaltschaft und der Kanton Waadt der Polizei totale Straflosigkeit gewähren. Die Waadt ist der Kanton mit den meisten Polizeimorden und in allen Fällen waren die Opfer Menschen afrikanischer Herkunft. Das Vorgehen der Staatsanwaltschaft bei den Todesfällen von Mike Ben Peter, Hervé Mandundu und Lamin Fatty hat sowohl auf nationaler als auch auf internationaler Ebene Wut und Besorgnis ausgelöst. Die Schweizer Behörden werden immer wieder von internationalen Kontrollorganen für Menschenrechte und Folterprävention kritisiert, insbesondere wegen mangelnder Effizienz und Unparteilichkeit bei der Untersuchung von Fällen von Polizeigewalt. Dieses Jahr wurde die Schweiz zum ersten Mal vom Europäischen Gerichtshof für Menschenrechte wegen Racial Profiling verurteilt. Leider scheint sich der Staat diese Kritik nicht zu Herzen zu nehmen.

Wenn der Verdacht besteht, dass eine Gewalttat einen rassistischen Hintergrund hat, sind die Ermittelnden theoretisch dazu verpflichtet, die Untersuchung auf “diesen spezifischen erschwerenden Umstand” auszuweiten. Der Kanton Waadt weigert sich jedoch, den systematischen und systemischen Rassismus seiner Institutionen - von der Exekutive bis hin zur Justiz - anzuerkennen. Zudem ist der Kanton nicht bereit, die Polizeigewalt als Folge von Rassismus zu sehen. Die Polizei tötet, die Staatsanwaltschaft spricht die Beamten frei und entschädigt sie, und der Kanton Waadt lässt dies unter Berufung auf die Begriffe Rechtsstaatlichkeit und Gewaltenteilung geschehen. Ein Staat, in dem sich die Beamt*innen den Regeln entziehen, die für den Rest der Bevölkerung gelten, ist kein Rechtsstaat.

Deshalb fordern wir die systematische Einleitung einer Administrativuntersuchung bei Fällen von Polizeigewalt mit Anzeichen auf einen rassistischem Hintergrund, um die Unparteilichkeit und eine rasche Untersuchung durch die Staatsanwaltschaft zu gewährleisten.

Nach Demonstrationen in Morges und Zürich und Unterstützungsanlässen in der ganzen Schweiz treffen wir uns am Samstag, dem 31. August in Lausanne, um drei Jahre nach Nzoys Tod unsere Wut herauszuschreien.

Dieses System hat bis heute die totale Straflosigkeit der Waadtländer Polizei aufrechterhalten. Wir gehen auf die Strasse, um Gerechtigkeit zu fordern.

Il 30 agosto 2021, Roger Nzoy Wilhelm, un uomo di colore di 37 anni residente a Zurigo, è stato colpito tre volte da un agente di polizia su un binario della stazione di Morges. Gli agenti di polizia presenti lo hanno lasciato a terra a pancia in giù per 6 minuti senza prestargli i primi soccorsi.

Nella primavera del 2023, il procuratore incaricato del caso annunciò che non avrebbe perseguito gli altri agenti presenti per non aver prestato soccorso. Poi, nell’autunno del 2023, ha finalmente avvertito l’avvocato della famiglia di Nzoy che, se non fossero state aggiunte nuove informazioni al fascicolo entro il 10 novembre 2023, chiuderebbe il caso - privando così la famiglia di Nzoy del diritto a un processo e a un’indagine seria.

Il modo in cui è stato trattato il caso di Nzoy ci mostra, ancora una volta, come l’ufficio del pubblico ministero e lo Stato vodese garantiscano alla polizia una totale impunità. Vaud è il cantone con il maggior numero di omicidi da parte della polizia e ogni volta le vittime sono persone di origine africana.
Sia gli enti nazionali che quelli internazionali hanno sollevato preoccupazioni sull’operato della Procura, in particolare nei casi di morte di Mike Ben Peter, Hervé Mandundu e Lamin Fatty. Le autorità svizzere sono spesso criticate dalle agenzie internazionali di controllo su questioni come la tortura e le violazioni dei diritti umani, in particolare per la loro inefficienza e mancanza di imparzialità nelle indagini sui casi di violenza da parte della polizia. Quest’anno, per la prima volta, la Svizzera è stata condannata dalla Corte europea dei diritti dell’uomo per il profiling razziale. Ma lo Stato sceglie di continuare a negare.
In teoria, se si sospetta che la violenza sia a sfondo razziale, gli investigatori sono obbligati a estendere l’indagine a “questa specifica circostanza aggravante”. Tuttavia, lo Stato di Vaud si rifiuta di ammettere il razzismo sistemico e sistematico delle sue istituzioni - dall’esecutivo al giudiziario - e si rifiuta di trattare la violenza della polizia come una conseguenza di questo razzismo. La polizia uccide, il procuratore assolve e risarcisce gli agenti, e lo Stato vodese permette che ciò accada, invocando i concetti di Stato di diritto e separazione dei poteri. Uno Stato in cui gli agenti di polizia non rispettano le regole obbligatorie che valgono per il resto della popolazione non è uno Stato di diritto.

Per questo chiediamo che un’indagine indipendente venga condotta al di fuori del Cantone di Vaud, per evitare qualsiasi vicinanza problematica tra la polizia e la procura vodese.

Dopo le manifestazioni di Morges e Zurigo e le serate di sostegno in ogni angolo della Svizzera, sabato 31 agosto ci incontreremo a Losanna per esprimere la nostra rabbia, a tre anni dai fatti.

Ad oggi, il sistema ha garantito alla polizia vodese la totale impunità fino ad oggi. Ci stiamo mobilitando per porre fine a tutto questo, per abbattere questo sistema e per fare giustizia.
